1. What the UDRP is
ICANN's process for resolving claims that a domain was registered and used in bad faith against someone's trademark. A complainant must show all three elements: the domain (a) is identical or confusingly similar to a mark they hold, (b) the holder has no rights or legitimate interest in it, and (c) it was registered and is being used in bad faith. Complaints are filed with an approved provider (e.g. WIPO or the Forum), not with us.
2. What we do as your registrar
- On provider notification, we lock the domain within two (2) business days (prevents transfers/changes but keeps the site running) and provide the provider the full registration data.
- We do not notify the respondent until the lock is applied (prevents cyberflight).
- The lock stays for the duration of the case.
- We implement a decision after the 10-business-day window following a decision for the complainant, unless we receive proof of a court challenge.
- We remove the lock within one (1) business day of being told a case is withdrawn or dismissed.
